Rules and ethics

Six separate legal questions to answer before marketing automation sends anything

Map marketing automation rules and ethics for 2027 across UK data protection, PECR, advertising claims, contracts and platform access controls.

Marketing automation rules and ethics do not form a single approval test. An organisation operating from England may need to examine UK data protection law, PECR channel restrictions, device storage or access, advertising rules, consumer law, supplier terms and the permissions configured inside its platform. Passing one check does not answer the others.

This guide was researched on 5 September 2026 for planning in 2027. It provides general information, not advice on a particular campaign or contract. Publication remains blocked until named qualified UK data-protection, advertising and commercial lawyers have checked the finished text against the intended audience, channel, data flow and offer.

What to take away

  • Passing one approval check does not answer the other five legal questions in marketing automation.
  • A platform role can permit an export but cannot create a lawful basis or PECR permission.
  • Record why the selected lawful basis fits the precise activity, not the general campaign.
  • Treat tracking technologies as their own implementation with a named inventory and documented exceptions.
  • Put claim evidence ahead of the send button because automation makes weak copy repeat faster.

Start with six separate questions

Six separate questions

QuestionWhat it governsEvidence to retain
What permits the use of personal information?A lawful basis under the UK GDPR, plus any extra condition for special-category dataPurpose record, basis decision, privacy information and any assessment
May this message use this channel?PECR rules for electronic mail, calls and other covered communicationsSubscriber classification, consent or soft opt-in evidence, preference check and sender details
May the journey store or read information on a device?PECR rules for cookies, pixels, scripts, local storage and similar technologiesTechnology inventory, purpose, exception or consent record and withdrawal route
Can the automated copy make this claim?CAP Code, consumer-protection law and sector-specific controlsFinal claim, audience interpretation, substantiation, qualification and approval date
What has the supplier agreed to do?Data-processing terms and the wider commercial bargainSigned terms, schedules, security information, subprocessor route and exit plan
What can a user or integration actually do?Technical platform roles, credentials and workflow authorityRole matrix, access test, change log and emergency revocation process

The last row is easily misunderstood. A platform role can permit an employee to export a list, but it does not create a lawful basis, PECR permission or a defensible advertising claim. Conversely, a sound legal assessment is of little operational use if excessive platform access lets somebody bypass it.

Mark the legal geography correctly

For an England-based team, most rules here operate at UK level. The UK GDPR and Data Protection Act 2018 govern personal-information processing, while PECR governs specified electronic communications and storage or access on equipment. The Data (Use and Access) Act 2025 amended that framework.

The ICO said on 19 June 2026 that all DUAA provisions affecting data-protection law and PECR were in force. Its change summary is for specialists and is not an application guide.

The non-broadcast CAP Code also applies across the UK within its scope. Consumer-facing marketing may engage the unfair-commercial-practices provisions of the Digital Markets, Competition and Consumers Act 2024. The CMA's current guidance says those provisions apply to practices from 6 April 2025 and explains misleading actions, omissions and other prohibited conduct.

The ICO can fine a UK GDPR breach up to £17.5 million or 4% of annual global turnover, whichever is higher. The DUAA increased the maximum PECR penalty to the same level, replacing the previous £500,000 ceiling.

The CMA can fine an unfair commercial practice up to 10% of annual global turnover or £300,000, whichever is higher. That power sits in the Digital Markets, Competition and Consumers Act 2024.

Do not label this an England-only regime. England is the operating context for the workflow in this article; the cited data and marketing rules have wider reach. A cross-border campaign may also raise other regimes. Qualified counsel should identify those rather than extrapolating from this UK guide.

Draw the data flow before choosing a lawful basis

List each source, field, inference, destination, user, supplier and deletion point. Split broad labels such as "personalisation" into actual purposes. Lead scoring for sales prioritisation, message delivery, suppression and performance analysis are not automatically one purpose.

Draw the Data Flow First

  1. List each source and field
  2. Split broad labels into purposes
  3. Choose and document lawful basis
  4. Retain assessment and safeguards
  5. Build objection route into automation

The ICO's lawful-basis guide was updated on 2 April 2026 for DUAA changes. It says organisations must choose and document a valid basis before using personal information, explain that basis in privacy information and reconsider it when the purpose changes.

It lists seven current bases, including the new recognised legitimate interest basis for specified purposes. That addition is not a general marketing shortcut.

Record why the selected basis fits this precise activity. If legitimate interests is being considered, retain the assessment and the safeguards. If consent is proposed, test whether it is specific, informed and capable of withdrawal. Separate this analysis from the PECR channel decision. A lawful basis for handling an email address does not by itself authorise an unsolicited email.

Build the objection route into the automation. The ICO's current lawful-basis page says people have an absolute right to object to the use of their information for direct marketing, whatever basis applies. A preference received through support, sales or a supplier should therefore reach the suppression control before the next send, not wait for a monthly list refresh.

Route messages by channel and subscriber type

The ICO's electronic-mail guidance covers email, text and other stored electronic messages under PECR. Its April 2026 update includes the DUAA charitable-purpose soft opt-in. For ordinary commercial activity, a team still needs to assess consent or every condition of the relevant soft opt-in rather than treating an existing contact as permission.

Route messages by channel

PECR channelRoute
Email and SMSRegulation 22 consent, unless the soft opt-in applies to an existing customer
Live marketing callsRegulation 21 consent, or the number is not registered on the TPS or CTPS
Automated callsRegulation 19 prior consent
Cookies and similar storage or accessRegulation 6 consent, except where strictly necessary

The soft opt-in requires details obtained in a sale or negotiations, similar products, and an opt-out at collection and in every message.

Business marketing needs a more careful classification than "B2B". ICO business-to-business guidance distinguishes corporate subscribers from sole traders and some partnerships. It also says UK GDPR duties can still apply when an individual's business contact details are processed. The page is marked under review because of the DUAA, so its current status belongs in the decision record.

For each automated route, retain the channel, intended recipient type, source of contact details, permission evidence, suppression checks, sender identity and working opt-out. If a platform changes how it classifies or sends a message, pause the journey until the PECR analysis is repeated.

Treat tracking as its own implementation

Email pixels, tags, device fingerprinting, scripts and web storage can fall within PECR's storage-and-access regime. The ICO finalised its revised storage and access technologies guidance on 29 April 2026. It describes multiple technologies, new statutory exceptions and the connection between PECR consent and UK GDPR duties.

Build an inventory naming each technology and its purpose, and never assume a vendor's "analytics" label proves an exception.

Where consent is required, block the non-exempt activity before the choice, record it, give the necessary information and make withdrawal work. If an exception is claimed, document which exception and why every condition is met. Reassess when a tag, purpose or data recipient changes.

Put claim evidence ahead of the send button

Automation makes weak copy repeat faster. CAP Code section 3 requires documentary evidence before publication for objective claims capable of substantiation. It also addresses qualifications and comparisons. A platform-generated variant needs the same evidence review as copy drafted by a person.

Build a claim register with the exact wording, likely audience meaning, source document, relevant period, material limitations, owner and expiry date. The approval should attach to the released version. A model or rules engine must not be allowed to introduce a superlative, performance number or comparison outside that envelope.

Commercial intent is a separate issue. CAP Code section 2 says non-broadcast marketing communications must be obviously identifiable. It also addresses unsolicited email and advertorials. A disclosure that disappears in a short mobile preview or after a content block is rearranged should fail the release test.

For consumer marketing, compare the whole presentation with the CMA guidance. Accurate fragments can still mislead through layout or omission. Check automated price blocks, eligibility conditions, renewal information and urgency messages together, in the order the recipient will encounter them.

Divide data terms from commercial terms

A marketing platform supplier may process personal information for the customer, act as an independent controller for another activity, or occupy different roles across features. Map roles per operation rather than assigning one label to the company.

The ICO's detailed controller and processor contract guidance identifies required processor-contract subject matter and terms, including documented instructions, confidentiality, security, subprocessors, assistance, end-of-contract provisions and audits. The ICO also states that this page is under review following the DUAA and that it is not a guide to commercial negotiation.

Legal review should therefore cover both the current data terms and the business bargain. Service descriptions, usage limits, support, availability, suspension, intellectual-property rights, price changes, renewal, liability, termination and export arrangements can affect whether the designed control works. Do not infer any of these from a feature page.

Cloud use may also raise international-transfer questions. The ICO's January 2026 international-transfer guide sets out a three-step approach and explains that other UK GDPR obligations still apply. Counsel must assess the actual entities, access and transfer mechanism.

Make platform permissions observable

Create a role matrix for list import, field creation, segmentation, content approval, journey activation, credential issue, integration changes, export and deletion. For every action, name the smallest role that needs it, who grants access, how approval is evidenced and how access is removed.

Test the matrix using non-live or appropriately governed data. Confirm a content editor cannot silently change eligibility. Check an integration cannot reactivate suppressed records. Ensure emergency suspension does not depend on the absent account owner.

Retain screenshots or exported settings with the product version and test date. This is operational evidence only; it says nothing about a campaign's legal validity.

Use a release dossier, not a compliance badge

Keep one register row per operation, not one row per platform. An abandoned-basket email needs its own row. Record the purpose and people affected, every data source and inferred field, and the proposed lawful basis and reviewer.

Then record the channel, subscriber class and PECR route, any cookies or similar technology, and the objective claims with their support. Finish with controller, processor and subprocessor roles, plus platform roles, override rights and stop control.

Before activation, assemble one dossier containing:

Use a release dossier

  • a data-flow and purpose record;
  • the lawful-basis and privacy-information decisions;
  • a channel and subscriber classification;
  • suppression and withdrawal test evidence;
  • a storage-and-access inventory;
  • the final copy with substantiation and disclosure approval;
  • supplier contracts, subprocessor information and transfer analysis;
  • the platform access matrix, failure test and rollback owner.

Each approval needs a named reviewer, scope, decision, conditions, evidence examined and expiry or trigger. A tool vendor, consent banner or template cannot certify the combined position. The team should use "approved for this defined release" rather than "compliant" because later changes can invalidate the reasoning.

Assign separate owners for data, channels, creative, procurement and technical access decisions. None of these owners can silently approve another's field.

Recheck on publication day

On intended publication date, a named UK data-protection lawyer must verify current UK GDPR, DPA 2018 and PECR position. An advertising lawyer or suitably qualified CAP specialist must recheck claims and disclosures; commercial counsel must examine the contract discussion.

The fact-checker must revisit every linked regulator page, especially those marked under review. They must also compare the ICO's guidance-plans page with this draft.

Delay publication if guidance status has changed, a commencement position cannot be confirmed, a cited page is superseded or a reviewer cannot reconcile the advice with the legislation. For an actual automation, repeat the release review when the audience, purpose, channel, technology, claim, supplier, subprocessor, transfer route or platform permission changes.

The practical next step is to pick one live journey and complete the six-question table with evidence owners. Any unanswered cell is a reason to pause that journey and obtain advice, not a reason to broaden an assumption.

Before you act

  • Draw the data flow before choosing a lawful basis.
  • Route each message by channel and subscriber type.
  • Retain permission evidence, suppression checks and a working opt-out.
  • Inventory each tracking technology and its purpose.
  • Document any claimed exception and why every condition is met.
  • Build a claim register with wording, evidence, owner and expiry date.

Common questions

Does a lawful basis for handling an email address authorise an unsolicited email?

No. The article says a lawful basis for handling an email address does not by itself authorise an unsolicited email. The PECR channel decision must be analysed separately, and passing one check does not answer the others. Record why the selected basis fits the precise activity.

How should business marketing be classified under PECR?

More carefully than B2B. ICO business-to-business guidance distinguishes corporate subscribers from sole traders and some partnerships, and says UK GDPR duties can still apply when an individual's business contact details are processed. That page is marked under review because of the DUAA, so its status belongs in the decision record.

What should happen when a platform changes how it classifies or sends a message?

Pause the journey until the PECR analysis is repeated. For each automated route, retain the channel, intended recipient type, source of contact details, permission evidence, suppression checks, sender identity and working opt-out. A platform role does not create a lawful basis or PECR permission.
